Municipal forms and new fee scale for architects
The PIA office has a small supply of the following municipal forms available to members:
Application to Approve Building Plans; Application for Encroachment of a Building Line; interpartite Agreement; Engineers Acceptance of Appointment; Engineers Completion Certificate; Information sheet : Application for approval of a site development plan; Documents required on submission of a site development plan.

A stock of the Recommended Tariff of Fees as issued by the South African Council for the Architectural Profession, which came into effect 1 January 2002, is also available. SACAP has confirmed that each registered architect did receive a copy, either posted or e-mailed. Copies (booklet form) are available at R 20.00 for members and R 40.00 for non-members.

When the Going Gets Tough -- Analyzing Concurrent Delays
Proving or disproving a construction delay claim is a substantial undertaking in the best of circumstances. But the analysis of construction delays takes a major leap in difficulty when there are multiple sources or causes of delay with interrelated effects. Even on straightforward projects, numerous activities for innumerable reasons are not completed exactly as scheduled. Is every activity that is not completed when scheduled a "delay," or are many of these inconsequential when assessing liability in a delay claim context?

Where to put your money
WITH interest rates rising but probably peaking and the JSE Securities Exchange SA coming off a strong rise, it is appropriate to ask a tricky question. What asset class would be the most appropriate investment from here on out? Fortunately, JP Morgan has just produced a voluminous study on the subject. The first question is: historically what has provided the best return, bonds or equities. The answer is equities, which is as it should be, since this is a riskier and more volatile asset class. The study found that equities outranked bonds over 10- and 15-year periods.

CETA News:
HMK CONSULTING has been commissioned by the South African Association of Consulting Engineers (SAACE) and the Construction Education and Training Authority (CETA) to assist companies with the successful submission of the Planning Grant due on 31 July 2002. This service is being offered free of charge to all CETA registered consulting engineering companies and professionals in the sector such as Architects, Quantity Surveyors and Town Planners throughout South Africa.

Each company registered with CETA needs to submit the Planning Grant by 31 July 2002. To assist companies in this regard, CETA has developed a computer software programme. This software programme will be distributed, free of charge, via a CD. Should a company require assistance on obtaining the CD, and submitting the necessary Grant Forms, please contact HMK CONSULTING (011 447 2250) as soon as possible. By participating in this programme, HMK CONSULTING will enable each company to obtain 15% of their levy rebate for the period 01 April 2002 to 31 March 2003.

Should the Implementation Grant, based on this Planning Grant, be successfully submitted and approved by May 2003, each company will be entitled to a further 50% of their total levies paid during this period.

Please remember that this service (i.e. submission of a Planning Grant) will be offered free of charge, courtesy of CETA. HMK CONSULTING is an outsourced generalist people management service offering the above benefits by an experienced and accredited consultant.

Liquidated Damages — a Two-Edged Sword
Delay can cause incalculable damages to an owner on a construction project. Such damages, however, may be very difficult to quantify with reasonable accuracy. Thus, in order to help avoid the uncertainty and expense of long evidentiary battles to establish (or refute) the owner's actual damages, parties to a construction contract may agree in advance to liquidate those damages. A “liquidated damages” clause is a negotiated clause to establish in advance a reasonable estimate of the damages that would be incurred by reason of a breach of contract or unexcused delays.

Did you hear?

This week we have two new ones for you:

Grounds for Divorce. . .

A woman goes into her lawyers office requesting a divorce. He is taking all of her background information and asks her, "Do you have grounds for a divorce?"

To which she replies, "Well, we have three acres."

"No, ma'am. What I mean is, does he beat you up?" asks the attorney.

"No, I get up around 6:30 and he sleeps until 7:00," she responds.

Feeling a little frustrated the attorney asks, "Lady, tell me, do you have a grudge?"

Looking very confident she states, "No, we have a carport."

At this point the lawyer has lost his patience and asks, "Look, Lady. Why the heck do you want a divorce?"

"Because he can't hold an intelligent conversation!"

AND

The engineer. . .

A priest, a doctor, and an engineer were waiting one morning at the third tee (par 3, 185 yards, slight dog leg to left, water hazard on the right) while a particularly slow group of golfers were flailing away ahead of them.

Engineer: What's with these guys? We've been waiting for 15 minutes!
Doctor: I don't know but I've never seen such ineptitude!
Priest: Hey, here comes the green keeper. Let's have a word with him.

Priest: Hi George. Say George, what's with that group ahead of us? They're rather slow, aren't they?
George: Oh yes. That's a group of blind fire fighters. They lost their sight while saving our club house last year, so we let them play here anytime free of charge!

Doctor: Wow! Thanks for the scoop George.
Priest: That's so sad. I think I will say a special prayer for them tonight.
Doctor: Good idea. And I'm going to contact my opthamologist buddy and
see if there's anything he can do for them.

After a short pause ...
Engineer: Why can't these guys play at night!
