| The Construction Sector Charter is published as a Sector Code on black economic empowerment in terms of Section 9(1) of the BBBEE Act, 53 of 2003. The CSC includes a scorecard that will help companies assess their progress in achieving BBBEE targets, which are measured in terms of seven basic categories. These categories are ownership, management control, employment equity, training and skills development, procurement, enterprise development and corporate social investment. The CSC clearly sets the objectives of empowerment relative to these categories. We have placed a copy of the gazetted Charter on our server for you to download. PASSING OF THESAN CHETTY

| It is with sadness that we wish to announce that after a sudden and fatal heart complaint, Mr Thesan Chetty, husband of our Debtors Clerk, Ms Merilda Naicker (maiden name), suddenly passed away at around 14h00 on Thursday 18 June 2009. He was only 32 years of age at the time of passing. His funeral was held in Durban on Saturday 20 June 2009. On behalf of the Board and all the members of the Association, we extend our deep and sincere condolences to Merilda and her family and friends for this tragic and sudden loss. May they be comforted and granted the strength of our Lord during this sad time.

ISSUE OF PRACTICE NOTES

| Members are advised that a policy of issuing regular Practice Notes will again be introduced to inform members of ongoing developments in matters surrounding day-to-day practice matters. Members will be publicly advised as and when such Practice Notes have been issued, and they will be made available and referred only to ASAQS members in the Closed User Group (CUG) section of the ASAQS website. Non-members will not be privy to this information.
Members are advised that the following Practice Notes have been issued and are available for member information in the CUG section of the ASAQS website as follows : - PN 1/2009 – Caution against introducing additional clauses into the standard Preliminaries bill
- PN 2/2009 – Sectional completion : Subdivision of preliminaries costs
- PN 3/2009 – Setting out of tender and contract documents for use with the JBCC series 2000 Principal Building Agreement (July 2007 edition 5.0)
- PN 4/2009 - Correcting arithmetic errors in tenders
The regular and ongoing issue of Practice Notes will in future be a regular feature of member information updates. It should be noted that members should also be encouraged to seek answers from the ASAQS to their practice questions, and in some cases this may result in a formal Practice Note being issued to formalise the official response of the ASAQS in that regard. | |

ALLEGED UNFAIR TENDERING PRACTICES

| ... FOR SINGLE PRACTICING QUANTITY SURVEYORS During the office closure over the past festive season, the ASAQS office received an anonymous letter from a "single practicing Quantity Surveyor" complaining about the alleged "unfair tender practices for Single Practicing Quantity Surveyors", with specific reference to BEE practices. The ASAQS office was asked for comment and to air the letter on the ASAQS website, which was duly done at the time (refer website newsletter dated 15 January 2009). Whilst anonymous letters are normally ignored and as they cannot be responded to, it was nevertheless felt that the complaint should be aired on the ASAQS website in this case, as requested. It was emphasised at the time that the views expressed in the letter do not represent the official views of the ASAQS, but rather represent the personal view of one of its "anonymous" members.
This matter has subsequently been debated at various levels to establish the general views of the membership on this matter. General input and comment was invited by the touring party of the ASAQS during the most recent Presidential visit around the country with the view of assessing the extent of the problem, and to what extent the membership supported the concerns expressed in the letter. A number of written submissions were also received by the ASAQS offices in this regard, in response to the invitation for members to respond and air their views. The responses expressed were found to encompass the entire spectrum of possibilities, each being mostly influenced by the background and personal experiences of the respective member.
The ASAQS has thus resolved that it will take every measure to ensure that the respective Government officials follow a professional and equitable process in the adjudication of tenders. This matter will be raised at the regular and ongoing NDPW Liaison Meetings held roughly quarterly to address specific problems experienced by our members. The main approach will be to request that tender procedures and openings be conducted in a totally transparent and open fashion for all to see. Anything less than that can only lead to suspicion and questioning of the system in place.
Members are invited to submit any specific concerns they may have in this regard so that this matter may be taken up (where appropriate) with the relevant authorities.
Please be advised that anonymous submissions will in future be ignored and disregarded !! No action will be taken in response to such submissions in future !! | |

CALL TO ALL CETA MEMBER COMPANIES TO SUBMIT WORKPLACE WSP'S

| The Construction Education and Training Authority (CETA) wishes to remind all levy paying member companies to submit their WSP and ATR submissions for the 2009/2010 financial year to CETA. The deadline for submission date is Tuesday 30 June 2009.
Members are advised to note the following: - The on-line system (SETA MANAGEMENT SYSTEM – SMS) for the WSP/ATR submission for 2009/2010 is live
- Hard copy submissions can be made to wspatr@ceta.co.za
- Both on-line and hard copy formats are freely available on the CETA website (www.ceta.org.za)
- No late submissions will be accepted and extensions will not be granted
- Proof of training, cancelled cheques and signed authorisation pages must be couriered, posted or hand delivered to the CETA offices
- An attached SDF letter of appointment should be provided to CETA.

CETA SMME AND NON LEVY ENTERPRISES WORKSHOPS

| In support of NSDS II, the Construction Education and Training Authority (CETA) invites all SMMEs, NGOs, CBOs and Co-operatives who are actively involved in the construction sector to attend regional workshops aimed at fact-finding, information-sharing and capacity building for these entities in the construction sector. Each region will hold its own workshop and CETA stakeholders are urged to register by completing a registration form and summitting to the nearest regional office. AN INVITATION TO SUBMIT PROJECT PROPOSALS TO CETA

| In support of NSDS II, the Construction Education and Training Authority (CETA) has identified skills development initiatives to achieve goals and objectives within the sector. CETA is thus inviting Constituent Employers (both non-levy and levy paying) to submit Project Proposals (proposed guidelines available from regional offices) to CETA Regional offices to deliver a number of development projects.
The evaluation criteria will be based on the 90/10 adjudication criteria (for proposals above R500 000,00) or on the 80/20 adjudication criteria (for proposals below R500 000,00). The points will be split and scored as follows: - 80/20 - 80 price and functionality, 20 preference (women, PDI and disabled)
- 90/10 - 90 price and functionality, 10 preference (women, PDI and disabled)
Expressions of interest to be submitted directly to the relevant regional office as outlined in the attached document.

A facility exists on the ASAQS website (www.asaqs.co.za) under the section of "LINKS" for practices to have their practice websites directly linked to that of the ASAQS website. This facility is absolutely free of charge and can be easily set up to allow automatic access at the press of a button. Please feel free to set up the link yourself at your convenience. To date only 18 of around 750 practices have made use of this facility and we would welcome greater participation in this regard.
Try it – it costs you nothing and you may be surprised at the results !! Please note that we experienced problems with this feature but it is now operational again. | |
