Event Name: Week 1-The objectives, the structure and the language of the NEC3 ECC

Nature of the CPD Event: Lecture

Course overview:

Getting familiar with the shape of this contract, how it is put together and even how it is expressed is the essential first task. We will look at the system of having main and secondary options and we will look at their content to see how, to some extent, the contract can be customised to the needs of a particular project. In this lecture we will also look closely at the content of Clause 1 and the relationship of the core contract to the Contract Data.

Course presenter:

After his admission as an attorney Terry Boxall spent the first twenty years of his working life lecturing in English language and literature at the University of Cape Town before returning to law in the early nineties, he established his own practice in 1995 where he specialised in contracts and property.

Since 2006 Terry has been lecturing on construction law and building contracts, primarily the JBCC and the NEC at the University of Cape Town. Specifically on the NEC he has facilitated in-house workshops with Eskom and with Sasol to develop understanding and confidence in dealing with that contract and has co-authored a recent article on the NEC ECC clause 10.1 in the Stellenbosch Law Review. He holds the degrees of BA(Hons) (English Language), LLM (Commercial Law) and MBA, all from the University of Cape Town and is an attorney and conveyancer of the Cape High Court.
