Notice to the profession: Draft BEP Law Amendment Bill 2017

On the 24th May 2014 a policy document on the proposed amendments of the statutory regulatory framework of the Built Environment Professions was placed in the Government Gazette for comment by the Department of Public Works. The Policy document was meant to identify possible solutions to the challenges encountered by the Built Environment.

According to the DPW research the challenges were broadly within the regulatory and organisational environment

Various options to address the challenges were advanced and the BEP Policy document was forwarded with the three Options for consideration, i.e.

  • Option 1 – A single CBE with six Professional Boards
  • Option 2 – The CBE and six Professional Councils (amending legislation)
  • Option 3 – Relocate the function of the CBE to the DPW

A consultation process with the registered persons was conducted through the Association of South African Quantity Surveyors on the three above-mentioned Options. The majority of the comments received from the registered persons were in support of Option 2. The Council submitted its comments to the Minister in favour of Option 2.

Now, because the final decision rested with the Minister of the Department of Public Works, we had to wait for the outcome of the Policy Paper. Three years down the line the Minister’s office circulated the 2017 Bill as advised by the comments made in 2014 on the Policy Paper.

Again, the Council would like the registered persons to take part in commenting on the Bill, 2017. Council’s Stakeholders will be engaged as well for comments on the Bill. This is an opportunity not to be missed, because through our legislation registration can be made compulsory.

This notice is accompanied by the Draft Built Environment Professional Law Amendment Bill, 2017 as an attachment.

The Council must submit its comments to the Council of Built Environment (CBE) by the 15th September 2017. Please make sure that your comments reach the Registrar’s office by the 30th August 2017 for consolidation.
